Professional Negligence

Ms Catherine Mun

 

Catherine Mun is a senior associate at Baker & McKenzie.  She has specialised in construction and arbitration law and practice since 1998.  Her work primarily focuses on construction and arbitration matters and PRC dispute work.  Catherine holds a LLB degree from the University of Hong Kong where she graduated with the only 1st class honours in her year, a BCL degree from the University of Oxford and two Professional Certificates in Foundation of PRC Law and PRC Civil and Commercial Law from Tsinghua University and the University of Hong Kong.  She is a contributor to the book “Arbitration in China: A Practical Guide” published by Sweet & Maxwell and a co-author of a chapter on “Cross-Border Arbitration” in the book “China Briefing’s Business Guide to the Greater Pearl River”.

Abstract

Doctors, lawyers, accountants, engineers and surveyors etc. are all professional.  A “Professional” is an acquisitive concept, acquisitive of aspirations and expectations – but also of liabilities.  So a professional generally owes certain duty of care to his or her client.  Breach of such duty may give rise to liability in the tort of negligence or under contract.  Nowadays, claims for professional negligence are increasingly common.  This is a result of a combination of various factors – increasing demand for services, specialization and higher standards and intolerance of bad performance by highly educated societies.  In this seminar, Ms Mun will discuss the basic principles of the tort of negligence and highlight recent case law and trends.
