Personal Injuries Claims In Construction Industry

 Yantl SZE is a Barrister and Mediator. Before joining the legal profession, Yantl had extensive experiences in both consulting and business areas in Asia Pacific Region. Yantl practices both criminal and civil cases. The areas of civil cases she practices including, but not limited to, contract, matrimonial, probate, personal injuries, shareholders agreement, intellectual properties, securities, employment, land, company and insolvency. She has appeared in her own right before the District Court, Family Court, High Court and Court of Appeal. For personal injuries, she has experiences in litigation relating to the liability and/or quantum of different types of personal injuries especially those arising from employment.

 

For work-related personal injuries, other than the compensation under Employees’ Compensation Ordinance, an injured employee may also seek common law compensation if the injury is more than minor. According to the data published by Hong Kong Government in April 2015, the Labour Department had handled 213 work-related fatal accident cases and 53,704 non-fatal cases in 2014. Among the non-fatal cases, 38,173 were injury cases with sick leave exceeding three days. In order to ease the case loading of the courts, it is mandatory in Hong Kong that all personal injury cases have to attempt mediation and trial is the last resort.

 

Other than the issue on liability which is always one of the major topics during trial, the other major topic will be the quantum to be awarded, which is always required to estimate upfront for both mediation or trial. This seminar will cover various topics in work-related personal injuries claims.
