Contracts Surgery on Valuation of Variations under the Hong Kong Government General Conditions of Contract

Mr. John Battersby, is a Director of BK SURCO Training and a Quantity Surveyor by profession having worked in the construction industry for 44 years, 28 years of which have been spent working on projects in Hong Kong. He is a Fellow of the Chartered Institute of Building, Hong Kong Institute of Construction Managers, Chartered Institution of Civil Engineering Surveyors, Chartered Institute of Arbitrators and Hong Kong Institute of Arbitrators and a Member of the Royal Institution of Chartered Surveyors and Hong Kong Institute of Surveyors. John has acted as an expert witness several times, both in arbitration and litigation, in respect of additional cost/loss and expense/damages claims, measurement issues, adjustment of rates, valuation of variations and causes and effects of delays to construction works.   

In this BK SURCO Contracts Surgery, John will give a presentation on valuation of variations under the Hong Kong Government General Conditions of Contract. This presentation will cover:

·                     principles of valuation under GCC Clause 61
·                     valuation of delays and disruption
·                     adjustments of overhead recovery and profit when valuing prolongation
·                     errors and omissions - are their time effects to be valued?
·                     Re-rating under GCC Clause 59(4)(6) – what are the factors to be taken into account?
·                     Prolongation – should its value or cost be assessed when the delay occurs or during the period over which the prolongation is prolonged?
